OF THE HARDYSTON TOWNSHIP COUNCIL MEETING HELD ON JANUARY
16, 2001
The
meeting was called to order by Mayor Lasinski at 7:00 P.M.
with the opening statement that the meeting had been duly
advertised and met all the requirements of the Sunshine
Law. Also present were: Councilman Ross, Councilman Armstrong,
Councilwoman Hamilton, Manager John Eskilson and Clerk Louanne
Cular.

was made by Ross to approve the consent agenda, seconded
by Hamilton. All in favor with Lasinski abstaining on the

AN ORDINANCE
TO AMEND THE ESTABLISHED MINIMUM AND MAXIMUM SALARIES FOR
OFFICERS AND EMPLOYEES OF THE TOWNSHIP OF HARDYSTON TO PROVIDE
THE METHOD FOR THE PAYMENT OF ANNUAL SALARY INCREMENTS IN
THE DISCRETION OF THE TOWNSHIP COUNCIL

ORDAINED by the Township Council of the Township of Hardyston
as follows:
Section
1. The minimum and maximum salary range for officers or
employees of the Township of Hardyston who are employed
on an annual salary basis shall be and is hereby fixed as
follows:

Section
3. Any officer or employee of the Township of Hardyston
who is at any time receiving less than the maximum compensation
or salary as hereinabove provided may, as hereinafter provided,
be given an additional annual increment of salary until
the maximum salary has been reached.
Section
4. No officer or employee shall be entitled to receive an
additional increment of salary until the same has been approved
by resolution of the Township Council, and no officer or
employee shall receive more than one (1) additional increment
of salary in any one calendar year.
Section
5. Nothing herein contained shall be so construed as to
make mandatory the payment of annual salary increments to
any officer or employee of the Township of Hardyston. Salary
or wage increases shall be contingent upon the availability
of funds and shall be granted on a merit basis.
Section
6. The Township Council reserves the right to pay a salary
to any new employee during his or her probationary period
of ninety (90) days which may be less than the minimum rate
of salary or compensation as hereinabove provided. However,
upon the satisfactory completion of such probationary period
said employee shall be paid not less than the minimum salary
provided for the particular office or employment.
Section
7. The Township Council further reserves the right to pay
a salary to any new employee at any figure between the minimum
and maximum salary provided for such office or position
and not necessarily the minimum salary.
Section 8. The adoption of this Ordinance shall not operate
to either increase or decrease the present pay of any officer
or employee of the Township of Hardyston, and the salaries
or compensations provided by existing ordinances shall remain
in full force and effect until such time as the Township
Council may grant and approve such additional increments
of salary as may be deemed advisable pursuant to the terms
of this Ordinance. A resolution of the Township Council
establishing specific salaries or wages may be made retroactive
to January 1st of the year in which the resolution is adopted.
Section
9. Salaries shall be paid in the same manner and the same
time as heretofore provided by ordinance.
Section
10. All ordinances or parts of ordinances which may be inconsistent
with the terms of this ordinance are to the extent of such
inconsistency hereby repealed.
A motion
was made by Hamilton to approve Ordinance 201-01 on first

NEW
BUSINESS:
A.
RESOLUTION IN SUPPORT OF SENATE BILL S-1833 AND COMPANION
ASSEMBLY BILL:
Whereas,
within the State of New Jersey, the County of Sussex, and
the Township of Hardyston, there are police officers whose
pension classification is known as Chapter 247 of PL 1993,
PERS/PFRS, and
Whereas,
Police officers classified as 247 PERS/PFRS are, under current
law and rule, restricted from realizing the regular benefit
of either PERS or PFRS retirement systems afforded to other
police officers in New Jersey, and
Whereas,
Chapter 247 PERS/PFRS officers may only receive a partial
retirement benefit from each system based on a formula applied
to the two separate pension systems resulting in a rate
greatly less then the other police officers through the
State of New Jersey, and
Whereas,
Senate Bill S-1833 seeks to remove this disparity for those
officers affected, by having the State Division of Pensions
transfer the Chapter 247 PERS/PFRS officers to receive full
credit in PFRS, with the State of New Jersey liable for
and paying directly to PFRS the full cost of the accrued
liability, with no cost to the Municipalities or to the
officers
Now
Therefore, Be It Resolved, that the Township Council of
the Township of Hardyston urges the Senate to adopt S-1833
;and
Be It
Further Resolved, that the Township Council urges the New
Jersey State Assembly to expeditiously introduce and enact
companion legislation; and
Be It
Further Resolved, that copies of this Resolution be forwarded
to the Honorable Robert E. Littell, the Honorable E. Scott
Garrett, the Honorable Guy Gregg, the Honorable Donald Di
Frencesco, Senate President, the Honorable Jack Collins,
Speaker of the Assembly and the New Jersey League of Municipalities.

B.
Resolution authorizing the Municipal Tax Assessor and Municipal
Attorney to defend tax appeals:
BE IT
RESOLVED by the governing body of the Township of Hardyston
that the Municipal Assessor and Municipal Attorney be and
they are hereby authorized to defend before the Sussex County
Board of Taxation and Tax Court of the State of New Jersey
all contested appeals and to initiate municipal appeals
to correct the Township of Hardyston tax list including
but not limited to rollback complaints, added and omitted
assessment complaints and such other appeals as are necessary
to correct the assessments for the Township of Hardyston;
and
BE IT
FURTHER RESOLVED that the Municipal Assessor and Municipal
Attorney be and are hereby designated as the agents of the
Township of Hardyston for the purpose of signing settlements
of the foregoing matters by stipulation.

FURTHER RESOLVED that governing body authorization shall
be required for stipulation resulting in the reduction of
annual taxes by $5,000 or more or for stipulations resulting
in a 50% or greater reduction in assessed value.

C.
Resolution designating depositories for 2001:
WHEREAS,
Title 4OA:5-14 requires that the governing bodies shall
designate official depositories for its moneys and:
WHEREAS,
the Township Council of the Township of Hardyston wishes
to designate the following banks for said purposes:

Resolution combining several bond ordinances and authorizing
the issuance of not to exceed $770,890 general improvement
bond anticipation notes.

E.
Resolution authorizing the Township Manager to execute the
following contracts/ leases/ interlocal agreements/agreements:

that the Township Manager is hereby authorized to execute
the following contracts/leases/agreements:

RESOLUTION
AUTHORIZING THE TOWNSHIP MANAGER TO PURCHASE MATERIALS THROUGH
THE SUSSEX COUNTY PRICING COUNCIL
WHEREAS,
the New Jersey Local Public Contracts Law (N.J.S.A.40A:1110)
enables two or more of governing bodies, by agreement, to
jointly purchase materials and services; and
WHEREAS,
on March 1, 1994 the Hardyston Township Council renewed
its membership in the Sussex County Cooperative Pricing
Council, a cooperative effort of local Sussex County governments
established under the provisions of N.J.S.A. 4OA:11-10,
for a period of five years; and
WHEREAS,
the County of Sussex, as lead Agency for the Sussex County
Cooperative Pricing Council has advertised for salt, grits,
fuel and lab services and;
WHEREAS,
as a result of those bids, the attached bid awards were
made by the County of Sussex on behalf of the Sussex County
Cooperative Pricing Council.
NOW
THEREFORE BE IT RESOLVED by the Township Council of the
Township of Hardyston that the Township Manager is hereby
authorized to purchase materials from the list attached,
awarded by the County of Sussex on behalf of the Sussex
County Cooperative Pricing Council per attached list:

F.
Resolutuion adopting the Department of Public Works Salary
Guide - BE IT RESOLVED by the Township Council of the Township
of Hardyston that the Public Works Department Salary Guide
attached hereto is hereby approved. (A copy is attached
at the end of these minutes)

G.
Resolution - Professionals for 2001:
WHEREAS,
there exists the need for an Attorney, Prosecutor, Auditor,
Bond Counsel, Public Defender, and Risk Management Consultant
to perform professional services for the Township of Hardyston;
and
WHEREAS,
funds are available for this purpose and;
WHEREAS, the Local Public Contracts Law (N.J.S.A. 40A:11-1
et seq.) requires that the resolution authorizing these
"Professional Services" without competitive bids
must be publicly advertised;
NOW THEREFORE BE IT RESOLVED this 1st day of February by
the Township Council of the Township of Hardyston as follows:
1. The
Township of Hardyston is authorized to engage Kevin Kelly
as Municipal Attorney.
2. The
Township of Hardyston is authorized to engage Anthony Den
Uyl as Municipal Prosecutor.
3. The
Township of Hardyston is authorized to engage Charles Ferraioli
as Municipal Auditor.
4. The
Township of Hardyston is authorized to engage Frohling,
Hudak & McCarthy as Municipal Bond Council.
5. The
Township of Hardyston is authorized to engage James Sloan
as Municipal Public Defender.
6. The
Township of Hardyston is authorized to engage The Woodland
Group as Municipal Risk Management Consultants.
7. These
appointments are awarded without competitive bidding as
a "Professional Service" under the provisions
of the Local Public Contracts Law because these services
are rendered by members of recognized professions.
8. A
copy of this Resolution shall be published in the New Jersey
Herald by the Township Clerk as required by law within ten
(10) days of its passage.
